ScanMyCopier Terms & Conditions

Welcome to ScanMyCopier! These Terms and Conditions ("Terms") govern your use of the ScanMyCopier software platform
("Service") provided by ScanMyCopier LLC ("Company," "we," "us," or "our"). By signing up for and using our Service,
you ("Customer," "you," or "your") agree to be bound by these Terms.
NON-DISCLOSURE AGREEMENT (NDA) & DATA PROTECTION
1. Confidential Information
The Company acknowledges that in the course of providing the Service, we may have access to confidential and
proprietary information belonging to the Customer, including but not limited to:
- Customer contact information and business data
- Machine and equipment records from Primera database
- Serial numbers, model numbers, and asset information
- Customer end-user information and service request data
- QR code label data and service history
2. Data Privacy & Third-Party Disclosure
ScanMyCopier WILL NOT share, sell, rent, or disclose your confidential data to any third parties for any purpose,
including but not limited to marketing, advertising, analytics, or any commercial purpose.
Exceptions: Data may only be disclosed:
- As required by law, court order, or government regulation
- To authorized Company personnel solely for providing and supporting the Service
- With your explicit written consent
3. Read-Only Database Access
For the machine pre-load add-on service, the Company will only require READ-ONLY access to your
Primera database to import existing machine records based on unique serial numbers ("Our Serial #" field).
We will NOT:
- Modify, delete, or alter any data in your Primera database
- Access any data beyond machine records necessary for the import process
- Retain copies of your Primera database after the import is complete
- Share Primera database access credentials with any third party
4. Data Security
The Company employs industry-standard security measures to protect your data, including:
- Encryption of data in transit (SSL/TLS) and at rest
- Secure Azure SQL Database hosting with restricted access
- Regular security audits and vulnerability assessments
- Multi-factor authentication for administrative access
- Automated backups with 30-day retention
5. Data Ownership & Portability
You retain full ownership of all data you provide to the Service. Upon request, we will provide you with an export
of your data in CSV or JSON format within 7 business days.
SERVICE TERMS
1. Service Description
ScanMyCopier provides a cloud-based software platform that enables copier and printer dealers to:
- Manage QR code labels for customer equipment
- Receive and track service requests via QR codes
- Print labels using Primera label printers
- Maintain machine inventory and customer records
2. Account Registration
You agree to provide accurate, current, and complete information during the signup process. You are responsible for
maintaining the confidentiality of your account credentials and all activities under your account.
3. Subscription Plans & Pricing
ScanMyCopier offers three subscription plans:
- Starter: $49/month + $99 one-time setup fee (Up to 50 labels/month)
- Professional: $99/month + $99 one-time setup fee (Up to 150 labels/month)
- Enterprise: $149/month + $99 one-time setup fee (Unlimited labels)
Machine Pre-Load Add-On: Optional one-time fee for importing existing machines from Primera database:
- Up to 500 machines: $99
- Up to 1,500 machines: $199
- Over 1,500 machines: $399
4. Payment Terms
- Subscription fees are billed monthly in advance
- Setup fees and add-on fees are charged once upon account activation
- All fees are non-refundable unless otherwise required by law
- We accept major credit cards and ACH payments
- Late payments may result in service suspension after 15 days
5. Acceptable Use Policy
You agree NOT to:
- Use the Service for any illegal or unauthorized purpose
- Attempt to gain unauthorized access to the Service or its systems
- Upload malicious code, viruses, or malware
- Resell, redistribute, or sublicense the Service without written permission
- Use the Service to send spam or unsolicited communications
- Reverse engineer, decompile, or disassemble any part of the Service
6. Service Availability & Support
- Uptime Guarantee: We strive for 99.5% uptime excluding scheduled maintenance
- Support Hours: Email support: Monday-Friday, 9 AM - 5 PM EST (Starter)
- Support Hours: Priority email: Monday-Saturday, 8 AM - 6 PM EST (Professional)
- Support Hours: Priority email + phone: 7 days/week, 8 AM - 8 PM EST (Enterprise)
- Response Time: Email inquiries answered within 24 business hours
7. Cancellation & Refunds
- You may cancel your subscription at any time from your account dashboard
- Cancellations are effective at the end of the current billing period
- No refunds for partial months or unused labels
- Setup fees and add-on fees are non-refundable
- Upon cancellation, your data will be retained for 90 days, then permanently deleted
8. Service Modifications
We reserve the right to modify, suspend, or discontinue any part of the Service with 30 days' notice. We will notify
you via email of any material changes.
LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- The Service is provided "AS IS" without warranties of any kind
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability is limited to the amount you paid in the last 12 months
- We are not responsible for data loss due to user error, third-party actions, or force majeure events
9. Intellectual Property
All content, trademarks, logos, and intellectual property related to the Service remain the property of ScanMyCopier LLC.
You are granted a limited, non-exclusive license to use the Service during your active subscription.
10. Indemnification
You agree to indemnify and hold harmless ScanMyCopier LLC from any claims, damages, or expenses arising from your use
of the Service or violation of these Terms.
11. Governing Law & Dispute Resolution
- These Terms are governed by the laws of the State of Delaware, USA
- Any disputes will be resolved through binding arbitration in Delaware
- You waive your right to participate in class-action lawsuits
12. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email 30 days in advance.
Continued use of the Service after changes constitutes acceptance of the new Terms.
13. Termination
We may terminate or suspend your account immediately if you violate these Terms, engage in fraudulent activity, or
fail to pay subscription fees after 30 days.
